Terms and Conditions

  1. INTRODUCTION

1.1. By making a purchase with Superior Decorating Ltd Trading as Superior Decorating Supplies, you agree to the following terms and conditions.

1.2. It is your responsibility to ensure that you are fully aware of all these terms and conditions when making a purchase with Superior Decorating Ltd either via the website www.superiordecoratingsupplies.co.uk or in person from a member of Superior Decorating Ltd staff.

1.3. These terms and conditions may be altered at any time, so you should review them each time you make a purchase on this website. The publication date is stated at the bottom of this document.

  1. GENERAL

2.1. In these Conditions:

  • "Customer" means the Customer indicated on the Order;
  • "Consumer" means a customer purchasing Products for personal use at a domestic premises;
  • "Contract" means any contract between the Customer and Superior Decorating Ltd for the sale and purchase of Products incorporating these Conditions;
  • "Price" means the price of the Products, which may be amended at any time before a Contract is formed;
  • "Products" refers to paint and other goods shown on the Order to be supplied by Superior Decorating Ltd;
  • "Order" means an order for Products submitted to Superior Decorating Ltd (i) either online through the Site or (ii) by email, fax, or telephone;
  • "Superior Decorating Ltd", “we”, “us” refers to Superior Decorating Ltd, a company registered in England and Wales with company number 05460702, whose registered office is 2nd Floor Crown House, 37 High Street, East Grinstead, West Sussex, RH19 3AF;
  • "Product Data Sheet" refers to all documents issued by a manufacturer that contain details about the safe supply, handling, and use of a Product, including but not limited to technical data sheets, safety data sheets, and application guides;
  • "Site" refers to superiordecoratingsupplies.co.uk;
  • "Trader" refers to a Customer who is not a Consumer.

2.2. These Conditions supersede all prior representations or arrangements and contain the entire agreement between the parties in connection with the Products. All other terms and conditions are excluded, including any the Customer may purport to apply, any implied by law, previous course of trading, and/or trade custom.

2.3. None of Superior Decorating Ltd's employees or agents have the authority to modify or supplement these Conditions.

2.4. Words in the singular include the plural and vice versa.

2.5. A reference to a statute or statutory provision is a reference to it as it is in force at the time, taking account of any amendment, extension, or re-enactment, and includes any subordinate legislation in force made under it.

2.6. We shall process all personal data of a Customer in accordance with our privacy policy.

  1. THE CONTRACT OF SALE

3.1. On occasion, an item may be mispriced. If you purchase a mispriced item, we reserve the right to cancel the contract and relist the product at the correct price.

3.2. We reserve the right to cancel any order at any time prior to delivery, for any reason. No contract of sale exists until your order is verified by a member of staff. Our initial order status, ‘Processed’, does not mean a contract of sale is in place. This only means that the order has been successfully received into our system. From there, validity and verification must take place before the contract of sale exists. We also reserve the right to downgrade the order status to 'Declined' should the order become unacceptable for any reason.

3.3. The contract made between us through any transaction is governed by UK law, using only the English language.

  1. ORDER PROCESS

4.1. All Orders, however placed, are subject to these conditions.

4.2. The Customer or their representative may only place an order if they are at least 18 years old and the delivery address is in the United Kingdom. At our request, you shall provide evidence of your age.

4.3. For Orders placed by telephone, fax, or email, we shall promptly send the Customer a written Order Confirmation. The Customer must carefully check the Order to ensure the Products set out reflect their requirements. If any changes are required, the Customer shall notify Superior Decorating Ltd by email within 1 hour of receipt, and we will amend the Order, which may include an amendment to the Price. If the Customer does not notify us within 1 hour, they will be deemed to have accepted the Order and these Conditions.

4.4. For Orders of Industrial Products, we recommend contacting Superior Decorating Ltd’s Technical Department to discuss your requirements and obtain a tailored specification and advice. Superior Decorating Ltd reserves the right to reject any Industrial Product order at its discretion. By placing an order for Industrial Products, the Customer warrants they have read and understood the relevant Product Data Sheets and possess the necessary expertise to use the Industrial Products.

4.5. A legally binding Contract will come into existence when Superior Decorating Ltd receives full payment and delivers the Products.

4.6. Once a Contract exists, we acknowledge our legal duty to supply the Products in conformity with these Conditions.

  1. DESCRIPTION OF THE PRODUCTS AND PRODUCT DATA SHEETS

5.1. Colour reproduction of the Products on the Site is limited by the technology used to deliver web pages and by the colour representation of the Customer’s own monitor and computer setup. We have made every effort to display as accurately as possible the colours of our Products, but we cannot guarantee that the colour shown on the Customer’s monitor will accurately reflect the colour of the Product on delivery. We recommend that the Customer first purchases the smallest available size or refers to an industry-standard colour chart in person (not digitally) to ensure that the colour is acceptable for its purposes.

5.2. The Customer agrees that, before placing an Order, they have read and understood the most up-to-date Product Data Sheet for the Product. Where we have access to the Product Data Sheet from the manufacturer, we will either provide a copy on request or include a PDF version on our website.

5.3. All Products are subject to availability. We will notify the Customer if all or part of an Order is out of stock, and the Customer may either cancel the unavailable Products for a refund or select alternatives, subject to any appropriate adjustment to the Fee.

  1. PRICE

6.1. All prices are displayed including VAT.

6.2. For telephone, email, and fax Orders, all sums due to Superior Decorating Ltd shall be paid via an order generated through the online website.

6.3. For online Orders, we accept payment by most major credit and debit cards.

6.4. The full amount of the Price, including any delivery costs, is due in advance of delivery or collection, unless otherwise agreed in writing by Superior Decorating Ltd.

6.5. If the Customer fails to pay any sum by the due date, Superior Decorating Ltd reserves the right to (i) suspend delivery or collection of the Products until payment is made, (ii) claim costs and interest under the Late Payment of Commercial Debts (Interest) Act 1998, or (iii) terminate the Contract.

6.6. Prices may be subject to change on a daily basis. We reserve the right to update prices during business hours.

  1. DELIVERY

7.1. Delivery will be deemed to have been effected when the Products leave the premises of Superior Decorating Ltd, or, where the Products are delivered directly by our suppliers, when the Products leave the suppliers’ premises. Delivery to the Customer will be completed when the Products are handed to a courier.

7.2. Delivery dates are given in good faith but are not guaranteed, and no liability will be accepted for any loss or damage caused through late delivery or non-delivery. Time of delivery shall not be of the essence.

7.3. Our liability for short delivery or damaged goods is limited to providing any missing Products or replacing or repairing damaged goods at our discretion.

7.4. If the Customer wishes to claim for short delivery or damaged goods, they must notify us in writing within 24 hours of delivery. If no such notice is given, the goods will be deemed to have been delivered in good condition and as per the delivery documents.

7.5. If short delivery occurs, the Customer may not reject the goods but should accept the partial delivery as part of the Order.

7.6. Superior Decorating Ltd shall not be liable for any complaints regarding short delivery or damaged goods unless we are given a reasonable opportunity to inspect the goods before they are used by the Customer.

7.7. Delivery or collection dates and timescales (if provided) are given in good faith but are not guaranteed. However, if you are a Consumer and we fail to deliver the Products within 30 days, you may cancel the Order and receive a full refund.

7.8. Delivery will be made to the address specified in the Order, and a valid signature may be required upon delivery or collection.

7.9. The Customer must accept delivery when the Products arrive at the delivery address. If the Customer fails to take delivery, we reserve the right to cancel the Order and refund the Price paid, less reasonable storage and delivery costs.

7.10. If the Customer has opted to collect the Products, they must do so within 5 days of being notified. Failure to collect within this period may result in cancellation of the Order, with the refund being reduced to account for storage costs.

7.11. Offshore deliveries: All local taxes and duties must be paid by the recipient. Special shipping costs apply and will be provided on a case-by-case basis.

7.12. While we aim for next-day delivery in most cases, this is not guaranteed, especially during busy periods. No compensation will be offered for delayed deliveries.

7.13. For national deliveries, we use various courier services. In rare circumstances where a parcel is not delivered within the agreed timescale, we will work with the courier to locate and deliver the parcel. Refunds or replacements will not be issued until the courier confirms the parcel is lost.

7.14. If a parcel is signed for but the recipient denies receiving it, this is classified as a denial of receipt. We will liaise with the courier to investigate. No action will be taken until the investigation is complete.

7.15. Many of our shipments require a signature upon delivery. Parcels may not be left without a signature unless the recipient provides express consent.

7.16. In a multiple-occupancy building, anyone present may sign for a delivery. It is the Customer’s responsibility to ensure they obtain the delivered parcel from the signatory.

7.17. If a parcel is returned to us undelivered, we reserve the right to charge additional delivery fees for subsequent attempts.

7.18. Upon receiving your order, inspect the packaging to ensure it has not been tampered with. If it appears damaged, refuse delivery. If you sign for the delivery, you are accepting the goods in their delivered state, and we cannot assume liability for any subsequent issues regarding damage or loss.

  1. COLOURS AND TINTING

8.1. Please note that we cannot accept returns or refunds for specially mixed or tinted paint colours once purchased, whether opened or not, as these colours are made to order and cannot be resold.

8.2. In the event of a colour dispute, all purchased tins must be returned at the Customer's expense for analysis by the manufacturer. This process may take several weeks. Once the manufacturer’s analysis is complete, we will inform the Customer of the findings. No credit or replacement will be issued without receipt of the analysis report. Any subsequent settlement will not exceed the original cost of the goods and will not include labour or other costs.

  1. CANCELLATION

9.1. If the Customer is a Trader, they may not cancel the Contract once it has been formed. If Superior Decorating Ltd agrees to cancel a Contract, the Trader must (i) not have opened the Products, (ii) obtain written approval, and (iii) return the Products within 14 days of delivery or collection in their original packaging at their own cost. If Superior Decorating Ltd deems the Products fit for resale, a refund will be issued minus a 20% restocking fee.

9.2. If the Customer is a Consumer, they have the right to cancel the Contract within 14 days of delivery or collection. To do so, they must notify Superior Decorating Ltd in writing and return the Products in good condition at their own cost within 14 days. If the entire Order is returned, we will refund the delivery cost up to the price of standard delivery.

9.3. A Consumer may not cancel a Contract if: (i) the Products are made to the Customer’s specifications, such as a custom-mixed colour, (ii) the Products are sealed and opened for health or hygiene reasons, (iii) the Products are used.

9.4. We reserve the right to cancel a Contract if: (i) we have insufficient stock to fulfil the Order, (ii) we do not deliver to the Customer’s location, (iii) the Customer fails to pay in full, (iv) the Customer cannot verify their age (if applicable), (v) a pricing error occurred. In the event of cancellation, a full refund will be provided, but no additional compensation will be offered.

  1. NOTICE TO CONSUMERS

10.1. Certain products, particularly in our industrial range, are intended for commercial use and require specialised knowledge regarding their application. While Consumers may submit an Order for these products, by doing so, Consumers expressly acknowledge and agree that:

10.1.1. We do not provide small test pots for these products.

10.1.2. Some products cannot be returned for reasons of health protection.

10.1.3. Certain products cannot be returned via Royal Mail or can only be returned if they meet specific packaging requirements.

10.2. Some products are for professional use only, as determined by the manufacturer and as indicated in the Product Data Sheet. In accordance with the guidance from the British Coatings Federation, we cannot sell professional-use-only products to Consumers. If you order a product described as professional-use-only, you will be liable for any costs, claims, damages, liabilities, penalties, and fines we incur as a result.

  1. DEFECTIVE OR MISSING PRODUCTS

11.1. If you are a Consumer, Superior Decorating Ltd warrants that the Products are of satisfactory quality and fit for purpose. If you are a Trader, we will use reasonable endeavours to ensure the Products meet these standards.

11.2. Customers should inspect the Products upon receipt. If the Customer is not a Consumer, they will be deemed to have accepted the Products unless they provide written notice of rejection within 24 hours of delivery, or (where the defect was not apparent on reasonable inspection) within 7 days of discovering the defect. If you are a Consumer, we request that you notify us promptly of any defect or missing Products.

11.3. If a valid notice of rejection is given but the Customer continues to use the Product, they will be deemed to have accepted the Products.

11.4. If it is proven to Superior Decorating Ltd’s satisfaction that a Product is defective or missing, we will either refund the purchase price or replace the Product within a reasonable time at no extra cost. For Traders, this refund or replacement will be Superior Decorating Ltd’s sole liability. Any replacement Products will be covered by the original terms of the Contract. Any Products alleged not to comply with the Contract must be preserved for inspection by Superior Decorating Ltd, and defective Products must be made available for collection if replaced.

11.5. Superior Decorating Ltd does not exclude any liability that cannot be excluded under applicable law.

  1. PRIVACY

12.1. We only store the information necessary to process a purchase. Your credit card information is not stored by us and is always processed securely our online payment provider.

12.2. We do not sell or lease your personal information. All data held by Superior Decorating Ltd is treated as entirely confidential.

  1. DISCLAIMER

13.1. Superior Decorating Ltd will not be liable for:

13.2. Any loss or damage to property or personal injury caused by the negligence of the Customer, including but not limited to failure to follow the Product Data Sheet, failure to wear appropriate protective clothing, or failure to ventilate the workspace adequately.

13.3. Any information provided by Superior Decorating Ltd that contradicts the Product Data Sheet.

13.4. Errors in coverage rates provided or quoted. Coverage depends on the condition of the substrate, surface absorption, texture, and the application method.

  1. FORCE MAJEURE

14.1. Superior Decorating Ltd will not be liable for any failure to fulfil the Contract due to circumstances beyond our reasonable control, which prevent or restrict us from performing the Contract.

14.2. Where reasonable, Superior Decorating Ltd may, without liability, suspend or terminate (in whole or in part) its obligations under the Contract if our ability to manufacture, supply, deliver, or acquire materials for the Products is materially impaired.

  1. TERMINATION

15.1. Superior Decorating Ltd may (without prejudice to our other rights or remedies) terminate or suspend our performance of all or part of the Contract if:

15.2. The Customer breaches any term of the Contract, including but not limited to failing to make payment by the due date.

15.3. The Customer becomes bankrupt or insolvent, or a receiver or encumbrancer takes possession of any of the Customer’s material assets.

15.4. Superior Decorating Ltd has reasonable grounds to suspect that the Customer will not pay sums due by the due date or will become insolvent.

  1. RISK AND TITLE

16.1. Risk in the Products passes to the Customer upon delivery or collection, as determined under these Conditions.

16.2. Title to the Products passes to the Customer when Superior Decorating Ltd receives full payment. Until title passes:

  • (i) The Customer must not use the Products and must store them separately and clearly identifiable as Superior Decorating Ltd’s property.
  • (ii) The Customer must store the Products in satisfactory condition and according to any instructions in the Product Data Sheet. Superior Decorating Ltd and its agents reserve the right to enter any premises where the Products are stored to recover them if payment is not made on time.
  1. LIMITATION OF LIABILITY

17.1. Superior Decorating Ltd’s liability to Consumers is limited to a refund of the Price paid under the Contract, unless the Consumer can demonstrate that additional loss was reasonably foreseeable and arose directly from a breach of the Contract. Superior Decorating Ltd will not be liable for wasted expenditure, including contractor costs, resulting from improper handling, use, or transportation of the Products.

17.2. Superior Decorating Ltd’s liability to Traders is limited to:

  • (i) a refund of the Price paid under the Contract;
  • (ii) no liability for loss of goodwill, profit, business, or anticipated savings, or for wasted expenditure; and
  • (iii) no liability for any indirect or consequential loss.

17.3. Nothing in these Conditions excludes or limits Superior Decorating Ltd’s liability for death or personal injury caused by our negligence or fraudulent misrepresentation.

17.4. It is the contractor’s or Customer’s duty to confirm the accuracy of colour matches before application.

17.5. Failure to confirm colour accuracy will result in no reimbursement for loss of earnings or labour costs for redecoration.

  1. MISCELLANEOUS

18.1. The Contract may not be assigned by the Customer without Superior Decorating Ltd’s prior written consent.

18.2. Notices must be in writing and sent to Superior Decorating Ltd or the Customer’s address provided in the Order. Notices will be considered delivered on the first working day after being sent by hand or on the third working day after being posted via first-class mail.

18.3. Superior Decorating Ltd’s failure to enforce any provision of the Contract shall not be construed as a waiver of our rights or as approval of any further breach.

18.4. If any provision of the Contract is found to be invalid or unenforceable, it shall be applied to the maximum extent permitted by law, or if not permitted, it shall be deemed deleted.

18.5. The provisions of Conditions 13, 16, 17, and 19 shall survive any termination of the Contract.

18.6. The Contract shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

  1. GIFT CARDS
  2. 19.1. Gift cards are redeemable only at Superior Decorating Supplies. The purchase or use of a gift card constitutes acceptance of these terms and conditions.

    19.2. Gift cards can only be used for the purchase of goods available on our website. Gift cards cannot be redeemed for cash, refunded, or exchanged for other gift cards, except as required by law. Any remaining balance on the gift card after purchase will remain available for future purchases until the balance reaches £0 or the gift card expires.

    19.3. Gift cards are valid for 12 months from the date of purchase. After the expiry date, the gift card will no longer be valid, and any remaining balance will be forfeited.

    19.4. Gift cards should be treated like cash. We are not responsible for lost, stolen, or damaged gift cards, and replacements will not be issued.

    19.5. Items purchased with a gift card are subject to our standard return policy. Refunds for items purchased using a gift card will be issued back to the gift card, where applicable.

    19.6. We reserve the right to refuse, cancel, or hold gift cards and orders for review if we suspect fraud or misuse. Gift cards cannot be resold or transferred for value without prior written consent from Superior Decorating Ltd.
